CANCELLATION AND REFUND

1- PARTIES
On the one hand, RSS TURİZM DANIŞMANLIK GIDA İNŞAAT TİC LTD ŞTİ (hereinafter referred to as AGENTA) located at the address Küçük Ayasofya Mah Küçük Ayasofya Cad No:28 Holiday Inn İstanbul Hote 28 / 1 Fatih İstanbul Fatih, İSTANBUL and on the other hand, the persons who will benefit from the service (Customer for short) hereinafter) have reached full agreement on the matters set forth below. In matters not written in this contract, the Law No. 1618 and the related Regulations, Regulations and Circulars, Communiqués and Schedules, S.K. 2634, IATA, IHA, UFTAA Convention Provisions and international private and official contracts will be applied.
A - At the time of registration, at least 30% of the total tour service fee and the balance must be paid no later than 15 days before the start of the tour. If the specified payments are not made within the aforementioned periods, the reservation is canceled and 30% of the total service cost is invoiced to the consumer as compensation for withdrawal.
B – The consumer who purchases Promotional, Discounted, Special Product service is obliged to pay the entire service fee on the reservation date. For special products and services, the balance must be paid no later than 60 days before the start of the service. Withdrawal compensation is the same as article 1/A.
2- CANCELLATION AND TRANSFER
A - Although the agency has shown all due diligence, it is an obstacle to the start or continuation of the trip; The trip may be canceled or postponed due to the fact that the final records do not reach the required number of passengers and/or adverse weather conditions, road obstructions, strikes, terrorism, fog, the possibility of war, unpredictable technical issues and all these and similar force majeure reasons. In this case, the consumer is not entitled to any compensation.
B - When the consumer requests cancellation up to 1 month before the start of the service, the full price paid is returned to him. If the consumer cancels the contract 20-15 days before the start of the service, he agrees and undertakes to pay 50% of the trip cost to the Agency less than 15 days before. Date changes made by the consumer have the effect of cancellation.
C- For promotional/discounted products, the consumer does not have the right to cancel or change the product they have purchased.
D- For special products, cancellations made up to 60 days before the start of the service, the consumer will be refunded the full price paid up to that point. If the consumer cancels the contract 59-31 days before the start of the trip, 25% of the trip cost, 50% of the trip cost if he cancels the contract 30-15 days before, 75% of the trip cost if he cancels the contract 14-07 days before. It accepts and undertakes to pay the full amount to the Agency less than 7 days before.
E- The amount paid for the service is returned to the consumer, provided that he or his first-degree relatives' 10-day discomforts that prevent their habitual occupation, which coincide with the tour period, are documented with an official report to be obtained from a full-fledged state hospital or in case of death. In this case, the report and documents will be submitted before the start of the service. If this situation occurs during the continuation of the tour service, the excuse must be submitted to the Agency with the document within maximum 1 day from the date of departure of the Consumer from the tour.
F- Until 7 days after the reservation date, the consumer may cancel the tour service received or transfer it to the person or persons he/she wishes, provided that it is suitable for the same reservation type. However, early reservation discounted products cannot be transferred to other people. The transferee is responsible for the balance and all costs arising from the transfer together with the transferor. The consumer is obliged to submit all cancellation/transfer requests to his agent in writing, in accordance with the above-mentioned period. If the service received is a product within the scope of the campaign and/or there is less than 7 days between the reservation and the beginning of the service, this article is not valid.
G- In case the consumer does not notify in writing that he will participate in the service that he missed the beginning of; The Agency has the right to cancel all reservations and services made on behalf of the Consumer, 24 hours after the start of the service. No refund will be made to the Consumer for such cancellations.
H- When deemed necessary, the Agency may partially or completely cancel the tours it has announced or registered, provided that it notifies the Consumer, before the start of the service. At the same time or during the service, the agency may change the names of the hotels within the scope of the service, transportation vehicles and their places of departure, and the order of visits of the places specified in the program and shown as places to visit. If the consumer does not accept these changes and cancellations for justified reasons, he has the right to cancel his reservation and get a refund of the unconsumed service fees.
 
3- GENERAL PROVISIONS
A- All kinds of responsibility regarding the baggage and its contents belong to the owner. The consumer is obliged to comply with the legislation and practices governing the vehicle to which he/she will travel and the facility where he/she will stay.
B- In cases of baggage loss or damage caused by the provider's fault; In the event that the consumer has the supplier arrange a loss or damage report, ½ of the total service cost, which corresponds to transportation, is paid to the consumer by the Agency as material and moral compensation for the lost goods and suitcase, regardless of the material and moral value of the goods in the baggage, as well as other qualities and characteristics. The agency, in writing, with its valuesIt is responsible for all kinds of loss, damage and theft of the goods that have been declared and received together, at the most, as much as the transportation cost of the tour.
C- The Agency is not responsible for force majeure after the start of the contracted service, situations arising from the Consumer and personal responsibilities of third parties. In cases within its responsibility, the Consumer may compensate the changes against the Consumer in the form of a price or service refund in accordance with the provisions of the TÜRSAB Kütahya Chart, as well as with additional and/or alternative arrangements that are not included in the price and given to the Consumer during the service. The fact that additional or substitute services have been purchased, used or consumed by the Consumer, eliminates the Consumer's right to refund and compensation.
D- Consumer; The guide accepts that he will comply with the rules declared by the guide, facility, agency, transportation vehicle authorities and the insurance company regarding the purchased service, will respect the safety and well-being of third parties, otherwise he will not be able to receive the service for just cause and there is no right to return the service.
E- In the event that the consumer terminates the service received on the grounds that the service performed is defective, he must notify the Agency representative and the hotel where he is staying, in writing, of the reasons for the termination. Otherwise, it is deemed to have received and used the service.
F- The fact that the consumer notifies the Agency in writing about the issues they complain about is the results of cooperation and judgment of good faith behavior.
G- The officer(s) who do not sign the contract but participate in the service subject to the contract, the lessees whom they have assigned to register on their behalf, are deemed to have accepted and committed to this contract with their prisoners. The right of recourse to other owners for the collection of the excess amount or service fee paid by the Agency to the consumer(s) who signed the contract is reserved.
H- If a package tour service is purchased, incomplete or non-performance of the package tour is covered by insurance in accordance with the law. Coverage is covered by the package tour price.
J- If the consumer wishes, he/she may insure the costs of returning to the departure point of the package service tour in case of previous accident and illness, and the costs and damages arising from any accident.
